Terms of Service

These Terms of Service govern your access to and use of the auraX.app website, mobile applications, and related services (collectively, the "Service") provided by auraX. By downloading, installing, or using our apps, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

Usage Agreement

By downloading or using the application, these terms will automatically apply to you. You should not copy or modify the application, any part of the application, or our trademarks in any way. You are not allowed to attempt to extract the source code of the application, translate the application into other languages, or create derivative versions. The application itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to auraX.

Auto-Renewing Subscriptions

Some auraX applications may offer paid subscription plans (such as weekly, monthly, quarterly, or yearly options) with in-app purchases processed through Google Play or other authorized platforms.

Payment will be charged to your account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
You may manage subscriptions and turn off auto-renewal in your device's account settings after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.

Service Changes and Charges

auraX is committed to ensuring that the application is as useful and efficient as possible. For that reason, we reserve the right to make changes to the application or to charge for its services, at any time and for any reason. We will never charge you for the application or its services without making it very clear to you exactly what you are paying for.

Your Information and Responsibilities

The application stores and processes personal data you have provided to us, in order to provide our service. It is your responsibility to keep your phone and access to the application secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware, viruses, malicious programs, compromise your phone's security features, and may mean that the application will not work properly or at all.

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when using the Service.

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of auraX and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of auraX.

General Prohibitions

You agree not to engage in any of the following prohibited activities:

Using the Service for any unlawful purpose or in violation of any applicable law or regulation;
Posting, transmitting, or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity;
Using the Service for unauthorized commercial purposes or spam;
Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service;
Using any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission;
Introducing viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

DMCA / Copyright Policy

auraX respects the intellectual property rights of others and expects users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through the Service, please notify us with sufficient information to permit us to locate the material and take appropriate action. We will respond to notices of alleged copyright infringement that comply with applicable law.

Third-Party Services and Links

The Service may contain links to other websites or services that are not owned or controlled by auraX. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Limitations of Responsibility

You should be aware that there are certain things that auraX will not take responsibility for. Certain functions of the application will require an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but auraX cannot take responsibility for the application not working at full functionality if you do not have access to Wi-Fi, and you do not have any of your data allowance left.

If you are using the application outside of an area with Wi-Fi, you should remember that your terms of agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the application, or other third-party charges. In using the application, you are accepting responsibility for any such charges, including roaming data charges if you use the application outside of your home territory without turning off data roaming. If you are not the bill payer for the device on which you are using the application, please be aware that we assume that you have received permission from the bill payer.

Along the same lines, auraX cannot always take responsibility for the way you use the application. You need to make sure that your device stays charged — if it runs out of battery and you cannot turn it on to avail yourself of the Service, auraX cannot accept responsibility. With respect to auraX's responsibility for your use of the application, when you are using the application, it is important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. auraX accepts no liability for any loss, direct or indirect, that you experience as a result of relying wholly on this functionality of the application.

Updates and Termination

At some point we may wish to update the application. The application is currently available on Android — the requirements for the system (and for any additional systems we decide to extend the availability of the application to) may change, and you will need to download the updates if you want to keep using the application. auraX does not promise that it will always update the application so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

We may also wish to stop providing the application, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the application, and (if needed) delete it from your device.

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Warranty Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Indemnity

You agree to defend, indemnify, and hold harmless auraX and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of and access to the Service, or a breach of these Terms.

Limitation of Liability

In no event shall auraX, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which auraX operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to These Terms

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
